Welcome to Phinomenon Inc. ("Company," "we," "us").
These Terms of Use ("Terms") are a binding contract between you and Phinomenon Inc. regarding your use of Phi Browser ("Phi") and our related services. By using Phi, you agree to these Terms. If you don't agree, you may not use Phi.

1. The Basics
- Eligibility: You must be at least 18 years old to use Phi. We do not knowingly collect data from children under 18.
- Your Account: You may need to create an account. You promise that the information you provide is accurate and that you will keep your password secure. You are responsible for all activity on your account.
- Updates: We may update these Terms as Phi evolves. We will notify you of material changes. Continued use means you accept the new Terms.
2. Privacy
We take privacy seriously. Please read our Privacy Policy to understand how we handle your data. It is part of these Terms.
3. Usage Rules
You agree to use Phi only for legal, personal purposes. You must not:
- Violate any laws or infringe on anyone's rights (including intellectual property).
- Harass, defraud, or deceive others.
- Interfere with our security or try to break into our systems.
- Scrape, crawl, or mass-copy data from Phi.
- Reverse engineer or attempt to steal our source code.
- Use Phi to build a competing product.
4. Content & AI Features
- Your Content: You own the data and content you create or upload ("User Content"). You grant us a license to use this content to provide and improve Phi (e.g., to display it on your devices or train our models, unless you opt out).
- Phi Content: We own the interface, software, and design of Phi. You may not copy or sell it.
- AI Output: Phi includes AI features. You own the "Output" (responses) generated for you. However, AI is evolving; Output may be inaccurate. You must verify it before relying on it.
- Skills: If you create and share automation workflows ("Skills"), you grant other users a license to use them. We may remove Skills that violate our policies at any time.
5. Third-Party Links
Phi allows you to access the entire internet. We are not responsible for third-party websites, extensions, or services you visit. Use them at your own risk.
6. Paid Features
- Fees: Phi is free, but some features may require payment ("Paid Features").
- Billing: We use Stripe, Inc. to process payments. By subscribing, you agree to their terms and authorize us to charge your payment method.
- Renewal: Subscriptions automatically renew unless you cancel via your account settings before the current period ends.
- No Refunds: Payments are generally non-refundable, even if you cancel early.
7. Copyright Infringement (DMCA)
We respect intellectual property. If you believe content on Phi infringes your copyright, please send a notice to our Designated Agent at privacy@phi.cc or our mail address below. Include:
- Your signature.
- Identification of the copyrighted work and the infringing material.
- Your contact info.
- A statement that you have a good faith belief the use is unauthorized.
- A statement under penalty of perjury that you are the copyright owner or authorized to act for them.
8. Disclaimers & Limitation of Liability
- "As Is": Phi is provided "as is." We make no warranties that it will be perfect, error-free, or meet your specific requirements.
- Liability Cap: To the fullest extent permitted by law, Phinomenon Inc. is not liable for indirect damages (like lost profits or data). Our total liability to you is limited to the greater of $100 or the amount you paid us in the last 12 months.
- Indemnity: You agree to indemnify (hold us harmless) against any claims resulting from your misuse of Phi or violation of these Terms.
9. Dispute Resolution (Arbitration)
Please read this carefully. It affects your right to sue in court.
- Mandatory Arbitration: Any dispute between you and Phinomenon Inc. arising from these Terms will be resolved by binding individual arbitration, not in court. There is no judge or jury in arbitration.
- Class Action Waiver: You waive your right to participate in a class action lawsuit or class-wide arbitration.
- Process:
- Informal: Before filing, we must try to resolve the dispute informally for 60 days. Send a written notice to privacy@phi.cc.
- Rules: If unresolved, arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
- Venue: Arbitration or any permitted legal action will take place in Los Angeles County, California, or another mutually agreed location, governed by the laws of the State of California (consistent with our US headquarters).
- Opt-Out: You may opt out of this arbitration agreement within 30 days of accepting these Terms by mailing a written notice to our address below.
